The Florida Supreme Court issued an order on Tuesday accepting jurisdiction in Alachua County, et al. v. Expedia, Inc., et al. (SC13-838). The central issue in the case is whether online travel companies such as Expedia and Hotels.com are required to collect and transmit a statutory Tourist Development Tax to counties on the entire payment they receive for a booking of a hotel room, or whether hotels are required to collect that tax from the (reduced) amount they receive from the online travel companies. At stake are potentially hundreds of millions of dollars in profit or tax revenue.
